Terms of service

Wolf-Horde is a trading name of LLC IC-EXPERT, a limited liability company formed in the State of New Mexico, United States. LLC IC-EXPERT operates the website at wolf-horde.com and is the seller of record for every order placed through it. In this document "we", "us" and "our" mean LLC IC-EXPERT.

These terms govern your use of wolf-horde.com and every order you place through it. By using the site or buying from it, you agree to them. Please read the sections on order acceptance, liability and disputes, which affect your legal rights.

Nothing in these terms removes rights your local consumer law gives you and does not allow you to give up. Where those rights conflict with anything below, those rights win.

1. Who you are contracting with

Your contract is with LLC IC-EXPERT, at the address above. You must be at least 18, or the age of majority where you live, to place an order.

2. Products, descriptions and images

We describe our products as accurately as we can, and every product page is written against that product's own specification and photographs. Even so, colors vary between screens, and handmade or printed items vary slightly from piece to piece. Minor variation of that kind is not a defect.

Where a product page states a measurement, material or age rating, it is taken from our supplier's specification for that item. If we discover a specification is wrong we will correct the page, and if you have already ordered on the strength of it you may return the item under our refund policy at our cost.

Some items are toys with a minimum age marked on the product page. Please follow it. It is a safety statement, not a suggestion.

3. Prices and payment

All prices are in United States dollars and exclude any import duty or local tax the destination country may charge, as explained in our shipping policy. Prices may change at any time, but a change never affects an order we have already accepted.

Payment is taken when you place the order. We accept the cards and wallets shown at checkout.

4. When your order becomes a contract

Your order is an offer to buy. Our confirmation email acknowledges that we received it; it is not acceptance. The contract is formed when we dispatch your order, and only for the items actually dispatched.

We may decline or cancel an order before dispatch, and will refund you in full if we do. We would do that if the item is out of stock, if we cannot ship to your address lawfully, if we suspect fraud, or if the item was listed at an obviously wrong price. Obvious pricing errors happen; this clause means neither of us is bound by one.

5. Delivery, returns and refunds

Delivery is covered by our shipping policy and returns by our refund policy. Both form part of these terms. Risk in the goods passes to you on delivery.

6. Your account

If you create an account, keep your password to yourself and tell us promptly if you think someone else has used it. You are responsible for activity on your account. Give us accurate information and keep it up to date, so we can actually deliver what you order.

7. Acceptable use

You may not use this site to break the law, to infringe anyone's rights, to harass or defame anyone, to introduce malicious code, to scrape or harvest data, to interfere with the site's security, or to buy for resale without our written agreement. We may suspend access for any of these.

8. Our content

The text, product descriptions, photographs, graphics, layout and code on this site belong to us or our licensors and are protected by copyright and other rights. You may look at them, share links, and print pages for your own use. You may not copy our product descriptions or images onto another store, and we do check.

9. Reviews and anything else you post

Reviews and comments must be your own honest opinion, based on real experience of the product. Do not post anything unlawful, abusive, misleading or infringing, and do not post a review in exchange for payment without saying so.

We publish reviews as they are submitted. We do not write reviews ourselves, we do not pay for them, and we do not delete a review simply because it is critical. We will remove one that is abusive, fraudulent, off-topic or unlawful.

By posting, you give us a non-exclusive, royalty-free, worldwide license to use, display and reproduce what you posted in connection with our business, and you confirm you have the right to grant it. We are not obliged to publish, keep or pay for anything you send us.

10. Copyright complaints

If you believe material on this site infringes your copyright, email contact@wolf-horde.com with "Legal notice" in the subject line, or write to us at the address above, and include:

  • your physical or electronic signature;
  • identification of the work you say is infringed;
  • identification of the material you want removed, with a URL;
  • your address, telephone number and email address;
  • a statement that you believe in good faith that the use is not authorized by the rights holder, its agent or the law; and
  • a statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act for them.

We remove properly notified material promptly. If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address.

11. Privacy

Your personal information is handled as described in our Privacy Policy, which forms part of these terms.

12. Third-party links

Where we link to another site, we do not control it and are not responsible for its content or its handling of your data. Read its terms before you use it.

13. Site availability

We try to keep the site running and accurate, but we do not promise it will be uninterrupted or error-free, and we may change or withdraw parts of it. Where information on the site turns out to be wrong, we may correct it, including after you have ordered, subject to clause 4.

14. Our liability to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Consumer guarantees that apply where you live are not affected.

Subject to that:

  • Products are sold as described on their product page. To the fullest extent the law allows, we exclude implied warranties of merchantability and fitness for a particular purpose.
  • We are not liable for losses that were not reasonably foreseeable, or for lost profit, lost revenue or loss of data.
  • Our total liability arising from any order is limited to the amount you paid for that order.

Some states and countries do not allow these exclusions, in which case they apply only as far as the law permits.

15. Indemnity

If you break these terms or use the site unlawfully and that causes a third party to bring a claim against us, you agree to cover our reasonable costs and losses arising from it. This does not apply to consumers to the extent local law prevents it.

16. Events outside our control

We are not liable for delay or failure caused by something genuinely outside our control, including carrier failure, customs action, natural events, strikes, epidemics, war, or the failure of a utility or a payment network. If such an event prevents us delivering, we will contact you and refund you in full.

17. Disputes, governing law and where claims are heard

Talk to us first. If you have a complaint, email contact@wolf-horde.com and give us 60 days to resolve it before starting proceedings. Almost everything is settled this way, faster and more cheaply than any court can manage. We will do the same before bringing a claim against you.

These terms and any dispute arising from them are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules, and the state and federal courts located in Bernalillo County, New Mexico have jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Two important exceptions.

  • You may always bring a claim in the small claims court where you live, if it qualifies. We will not try to move it.
  • If you are a consumer in the European Union or the United Kingdom, nothing here deprives you of the protection of the mandatory laws of your country of residence, or of your right to bring proceedings in your local courts.

There is no arbitration clause in these terms, and no class action waiver. If we ever add one we will tell you before it takes effect.

18. Accessibility

We want this site to be usable by everyone, including people using screen readers or keyboard navigation. If any part of it is a barrier for you, email contact@wolf-horde.com with "Accessibility" in the subject line, tell us the page and what happened, and we will fix it and help you complete your order in the meantime.

19. General

  • If any clause is found unenforceable, the rest stays in force.
  • If we do not enforce a right immediately, we have not given it up.
  • You may not transfer your rights under these terms; we may transfer ours if we sell the business, and it will not reduce your rights.
  • You agree that we may communicate with you electronically, and that emails and electronic records satisfy any legal requirement for writing.
  • These terms, with the policies they refer to, are the whole agreement between us about the site and your order.

20. Changes to these terms

We may update these terms. The version in force for your order is the one published when you placed it, and we keep the date below current so you can tell. Changes are never applied retroactively to an order already accepted.
